The Delhi High Court has issued an interim injunction preventing T-Series from using the titles ‘Tu Hi Aashiqui’ or ‘Tu Hi Aashiqui Hai’ for any upcoming films.
This decision favours Vishesh Films, co-producers of the original ‘Aashiqui’ series. The court acknowledged the ‘Aashiqui’ title as a significant brand linked to successful films released in 1990 and 2013. Justice Sanjeev Narula stated that the use of these titles by T-Series could cause public confusion and dilute the ‘Aashiqui’ brand. Vishesh Films had registered trademarks for ‘Aashiqui’ in 2013 and ‘Aashiqui Ke Liye’ in 2014.
The court highlighted that both companies had previously collaborated on the ‘Aashiqui’ films, and neither could exploit the franchise without the other’s consent. The ruling comes after T-Series announced a film with a similar title, which Vishesh Films argued could mislead the public.
The court also noted that the ‘Aashiqui’ name has become an integral part of a recognised film series, and protecting such titles is crucial to maintaining their distinctiveness. Vishesh Bhatt, Managing Director of Vishesh Films, expressed satisfaction with the judgement, stating it upholds their commitment to preserving their franchise’s legacy. The court’s decision emphasises the importance of protecting well-known series titles to avoid misleading consumers and diluting brand identity.
